In the Treasurer’s race, challenger Walker Stapleton (R-Colorado) is ahead of incumbent Cary Kennedy (D-Colorado), 42-39 percent with 20 percent undecided. The candidates seeking to become the next Secretary of State are very close according to the poll with challenger Scott Gessler (R-Colorado) receiving 37 percent and incumbent Bernie Buescher (D-Colorado) earning 33 percent. In all of those races, a larger number of independent voters are saying they support Republican candidates instead of Democratic ones.

CO: Another Endorsement for AG John Suthers

From the Durango Herald:

Attorney General John Suthers also should be retained. Suthers says his strengths are that he is both a good lawyer and a good manager. And there is scant evidence to the contrary.

That he signed on to a constitutional challenge to the health-care reform bill seems unnecessary and partisan, but his explanation – that he is charged with defending federalism – is plausible. In any case, filing such “amicus” briefs is common practice.

Charges that he is weak on consumer protection have gained little traction. Prosecutions of consumer and white-collar crimes are up under Suthers.

The best reason to re-elect him, however, is political. The next governor will need to make massive budget cuts, which likely include cuts to prison spending. Who better to ensure those do not threaten public safety than a law-and-order guy like Suthers?

CO: Statehouse a game of numbers

From Durango Herald:

The next decade of political dominance in Colorado comes down to two simple numbers: six and four.

Republicans need to take six seats in the state House and four in the state Senate to claim control of those chambers after six years of Democratic leadership.

The prize is the ability to redraw congressional districts after the 2010 census, making it easier for the winning party to hold onto competitive seats in rural Colorado through 2020.

The outcome might hinge on a game of addition and subtraction among Southwest Colorado legislators.

Republicans see Rep. Ellen Roberts’ race against incumbent Democratic Sen. Bruce Whitehead as their top opportunity to pick up a Senate seat. But they currently have a 21-14 disadvantage in the Senate, so they would need three more seats, if Roberts wins, to gain control.

They are betting on a national mood that has Democrats on the defensive.

CO: Marijuana Group Likes Democrat AG Candidate

From DailyCamera.com:

A marijuana advocacy group plans to laud Colorado attorney general candidate Stan Garnett and other candidates Wednesday in downtown Denver for their positions on pot regulation.

The group, SAFER, said it sent a survey to candidates asking whether marijuana should be regulated similarly to alcohol and whether adults 21 and older should be allowed to possess up to one ounce of pot.

It said Garnett, Boulder County’s district attorney, responded that he supported such a regulatory scheme. His opponent, State Attorney General John Suthers, was cited for being vehemently opposed to the legalization of marijuana.

CO AG Challenger Split with AG on Health Care Suit

From Denver Post:

A March e-mail exchange between Attorney General John Suthers and Boulder District Attorney Stan Garnett appears to show the challenger was an early supporter of the incumbent.

The e-mails recently came to light after Colorado Ethics Watch filed an Open Records Act request seeking information on the costs of Suthers joining in on a lawsuit opposing the health care bill.

Garnett told Suthers he was pulling support for his candidacy because he believes joining the suit is inappropriate.

“Your decision to engage Colorado in this legal battle is cynical and partisan, and outside the appropriate role for a state attorney general,” Garnett wrote in the March 22 e-mail. “Those who wondered why I, as a progressive Democratic DA would endorse a Republican AG, which I was doing as recently as yesterday, will wonder no longer.”

CO: Campaign Finance Complaint Filed against Democrat Secretary of State

From AuroraSentinel.com:

A Republican activist filed a complaint against Secretary of State Bernie Buescher, claiming the Democrat broke the law by using state workers to coordinate his campaign for re-election.

The complaint, received by the secretary of state’s office Wednesday, said Buescher used his executive assistant, Heidi Hamilton, on state time for to help manage campaign appearances. Buescher’s calendar shows a meeting April 20 between Faye Diamond, a partner for RBI Strategies & Research, Buescher, Hamilton, and campaign committee member Eleni Albrechta. Denver attorney Robert McGuire, who filed the lawsuit on behalf of Nickelette Bingham-Gullette, said Buescher ordered Hamilton to attend.

“It’s an illegal contribution for a candidate to use state time and office resources,” McGuire said.

All campaign finance complaints must be filed with the secretary of state’s office. Buescher’s spokesman, Rich Coolidge, said the complaint was forwarded to the Attorney General John Suthers, who will investigate and determine whether he will represent Buescher or advise him to get another lawyer. An administrative law judge must hold a hearing in 15 days unless Buescher requests an extension.

CO: AG and Challenger Clash in Debate

From the Colorado Statesman:

The two candidates vying for the attorney general post on the November ballot squared off again this week, this time on a debate that was televised Friday evening.

Democrat Stan Garnett and incumbent Republican John Suthers continue to spar over Suthers’ participation in a lawsuit against the federal government over health care reform. Tuesday’s debate also covered medical marijuana, ballot initiatives, and how to cut the budget of the AG’s office next year.

The debate was taped Tuesday afternoon at the studios of CPT-12 (formerly KBDI), in conjunction with KCNC-TV4. It aired on CPT-12 on Friday at 9:30 p.m. as part of the “Colorado Decides” series, leading up to the November election.

Suthers defended his decision to join in a lawsuit filed last March against the federal government by a dozen other attorneys general. The lawsuit seeks to block implementation of health care reform; specifically, portions of the law that require individuals to purchase health insurance. The lawsuit also challenges the constitutionality of the penalties that would be assessed to those who disregard the law but do not qualify for exemptions because of income or other allowable reasons.

From the Denver Post:

The 2010 Colorado legislative session closed Wednesday with lawmakers scrambling to pass bills limiting teacher tenure and eliminating a tax break for seniors.

As the clock ticked down, legislative leaders glanced forward to the most pressing problem they will face next year: how to fund higher education.

“I think that finding a stable funding source to sustain our institutions of higher education would be a top priority going into next year,” said Senate President Brandon Shaffer, D-Longmont. “How do we backfill from the stimulus dollars going away?”
