DE: Bill Limiting Eminent Domain Can’t Overcome Veto

The politics of this one will be interesting.  Questions will be raised about why some members voted to pass the bill, but didn’t vote to overturn the veto – in essence a chance to vote for it again.  You can expect to see this one again.  From DelawareOnline:

Legislation to put controls on government use of eminent domain was killed Monday night after a call to override Gov. Ruth Ann Minner’s weekend veto of the bill did not survive the state Senate.

A motion by Sen. Robert Venables, D-Laurel, to override the veto of Senate Bill 245 during the final hours of this year’s legislative session failed 11-9, with one legislator not voting.

An override would have required a three-fifths vote in both chambers, including 13 votes in the Senate, to pass.

“It was not easy to go against the governor,” said Venables, who sponsored the bill. “But on an issue as important as this, you have to.”

S.B. 245 would have made taking private property by eminent domain more difficult for governmental entities and could have hampered development along Wilmington’s waterfront and elsewhere in Delaware.

The bill passed through both chambers earlier this month with only one dissenting vote, Rep. Anthony DeLuca, D-Varlano.

Venables shook his head when asked why so many legislators who initially approved the measure did not support the override. He blamed self-interests and the pressures of an election year, and vowed to try again next year.
